1. Acceptance of Terms

By accessing and using CheapSMS.com ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our service. These terms apply to all visitors, users, resellers, and customers of CheapSMS.com.

2. Services Provided

CheapSMS.in provides bulk SMS, WhatsApp messaging, RCS messaging, voice call services, VoIP solutions, DID/toll-free numbers, Cloud PBX, MS Teams Direct Routing, and A2P SMS services. All services are subject to availability and may change without prior notice.

3. Account Registration & Eligibility

• You must be 18 years or older to register and use our services
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• One account per entity/person unless prior written approval is obtained
• Business accounts must provide valid GST, PAN, and company registration documents

4. Acceptable Use Policy

Users must comply with all applicable laws including TRAI regulations, DLT guidelines, and the Information Technology Act 2000. The following are strictly prohibited:

• Sending spam, unsolicited messages, or messages to users who have opted out
• Phishing, fraud, or any deceptive messaging practices
• Sending content that is illegal, defamatory, obscene, or harmful
• Violating DLT (Distributed Ledger Technology) compliance requirements
• Using our services for drug trafficking, illegal gambling, or terrorist activities
• Sending messages to NDNC registered numbers via promotional routes

5. Payment & Billing

• All payments are non-refundable unless otherwise stated in our refund policy
• Prices are subject to change with 30 days written notice
• GST/taxes will be applied as per Indian government regulations
• Accounts with insufficient balance may be suspended automatically
• Disputed charges must be raised within 30 days of billing

6. Limitation of Liability

CheapSMS.in shall not be liable for any indirect, incidental, special, or consequential damages arising from use of our services. Our maximum liability is limited to the amount paid for services in the 3 months preceding the claim. We do not guarantee delivery of messages as network conditions are beyond our control.

7. Termination

We reserve the right to terminate or suspend any account immediately without notice if we determine that the user has violated these terms, engaged in fraudulent activity, or used our services in a manner that could harm other users or our reputation.

8. Governing Law

These terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India. These terms constitute the entire agreement between you and CheapSMS.com.
